Welcome to PavilionHaus. These Terms of Service (“Terms”) govern your use of www.pavilionhaus.com and any purchases made through our website.
PavilionHaus is operated by BH Stores LLC, a Nevada limited-liability company. Throughout these Terms, “PavilionHaus,” “we,” “us,” and “our” refer to BH Stores LLC and the PavilionHaus online store.
By accessing our website or purchasing a product from us, you agree to these Terms. If you do not agree with these Terms, please do not use our website or place an order.
1. Online Store Terms
By using this website, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian to use this website.
You may not use our products, website, or services for any unlawful or unauthorized purpose.
You may not attempt to interfere with the security, operation, or functionality of our website.
2. Products and Product Information
PavilionHaus offers outdoor living products including pergolas, gazebos, greenhouses, and related products supplied by third-party manufacturers.
We make reasonable efforts to display product descriptions, specifications, dimensions, colors, images, features, and other information accurately. However, manufacturers may occasionally update products or specifications without prior notice.
Colors and product appearance may also vary depending on your device, screen settings, lighting, and manufacturing variations.
Customers are responsible for reviewing product dimensions, specifications, installation requirements, and other relevant information before purchasing.
3. Pricing
All prices displayed on PavilionHaus are listed in U.S. dollars unless otherwise stated.
We reserve the right to update prices at any time without prior notice.
In the event of an obvious pricing, typographical, technical, or product-information error, PavilionHaus reserves the right to correct the error and, when appropriate, cancel or decline an affected order. If payment has already been collected for an order that we cancel, the applicable amount will be refunded to the original payment method.
4. Orders and Order Acceptance
Submitting an order through PavilionHaus does not guarantee acceptance of the order.
After an order is submitted, we may verify product availability, pricing, payment information, shipping information, and other order details.
We reserve the right to decline or cancel an order when reasonably necessary, including because of product unavailability, pricing or listing errors, suspected fraud, payment issues, shipping restrictions, or circumstances that prevent us or the applicable manufacturer from fulfilling the order.
If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method.
5. Product Availability
Product availability is subject to change without notice.
Because PavilionHaus works with third-party manufacturers and suppliers, an item displayed on our website may occasionally become unavailable before our website inventory is updated.
If a product becomes unavailable after you place an order, we will contact you regarding available options, which may include waiting for restock, selecting another product when appropriate, or receiving a refund.
6. Payment
You agree to provide current, complete, and accurate billing and payment information for all purchases.
By submitting payment information, you represent that you are authorized to use the payment method provided.
Payment processing may be performed by third-party payment providers. Your use of those payment services may also be subject to the provider's applicable terms and policies.
7. Shipping and Delivery
Shipping methods, processing times, delivery estimates, and delivery procedures vary depending on the product, manufacturer, availability, and destination.
Many PavilionHaus products are oversized outdoor structures and may be delivered by freight carrier.
Estimated delivery dates are estimates and are not guaranteed. Weather, carrier scheduling, product availability, freight conditions, and other circumstances outside our reasonable control may affect delivery.
Customers are responsible for providing complete and accurate shipping information and for ensuring that the delivery location is reasonably accessible for the applicable delivery method.
Please review our Shipping Policy and the shipping information displayed on the applicable product page before placing an order.
8. Inspection Upon Delivery
Customers should inspect shipments as soon as reasonably possible after delivery.
If a shipment appears damaged, defective, incomplete, or incorrect, please document the condition of the product and packaging with photographs or video and contact PavilionHaus promptly at support@pavilionhaus.com.
Some products may arrive in multiple packages or shipments.
9. Returns and Refunds
Returns, refunds, damaged products, defective products, and incorrect orders are governed by our Return & Refund Policy.
Customers should review that policy before purchasing.
Do not return a product without first receiving return instructions from PavilionHaus.
10. Order Cancellations
If you wish to cancel an order, contact PavilionHaus as soon as possible.
We will make reasonable efforts to accommodate cancellation requests. However, once an order has entered processing, preparation, manufacturing, or shipment, cancellation may no longer be possible.
Orders that cannot be canceled may be subject to our Return & Refund Policy.
11. Assembly, Installation, Permits, and Site Requirements
Many products sold by PavilionHaus require assembly, installation, anchoring, site preparation, or other work after delivery.
Unless expressly stated otherwise in writing, assembly and installation are not included with the purchase of a product from PavilionHaus.
Customers are responsible for determining whether permits, approvals, inspections, engineering requirements, homeowners' association approvals, zoning requirements, or other local requirements apply to the installation or use of a product.
Customers are also responsible for ensuring that the intended installation location is suitable for the product and that installation is performed in accordance with manufacturer instructions and applicable requirements.
PavilionHaus does not guarantee that a particular product will satisfy building codes, permitting requirements, HOA requirements, or other regulations in every jurisdiction.
12. Manufacturer Warranties
Certain products sold through PavilionHaus are covered by warranties provided by their respective manufacturers.
Warranty coverage, duration, exclusions, and claim procedures vary by manufacturer and product.
Where applicable, PavilionHaus will assist customers in coordinating warranty-related communication with the manufacturer. Manufacturer warranties remain subject to the applicable manufacturer's warranty terms and conditions.
Nothing in these Terms is intended to eliminate any rights or warranties that cannot legally be excluded under applicable law.
13. Third-Party Manufacturers and Suppliers
PavilionHaus works with independent manufacturers, suppliers, freight carriers, payment processors, and other service providers to fulfill orders and operate our store.
We are not responsible for delays or failures caused solely by circumstances outside our reasonable control, including carrier disruptions, severe weather, supply-chain interruptions, manufacturer delays, natural disasters, government actions, or similar events.
This section does not limit any rights or remedies that cannot legally be limited under applicable law.
14. Third-Party Links and Services
Our website may contain links to third-party websites or services.
PavilionHaus is not responsible for the content, availability, privacy practices, or policies of third-party websites. Accessing third-party websites is at your own discretion and may be subject to separate terms and policies.
15. Intellectual Property
The PavilionHaus website and its original content, branding, graphics, layout, text, and other materials are owned by or licensed to PavilionHaus, except for manufacturer materials, trademarks, product photographs, or other content owned by their respective rights holders.
You may not reproduce, distribute, modify, sell, or commercially exploit website content without appropriate authorization.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and any other policies or terms expressly incorporated into your purchase, constitute the agreement governing your use of PavilionHaus and purchases made through the website.
23. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
